Terms And Conditions (“Terms”) For Deutsche Bank’s Awards For Creative Enterprise (The “Competition”)

THE COMPETITION
The Competition offers entrants the chance to win £10,000.00 to fund their creative project and a year of business mentoring. It is an awards programme designed to provide financial and business support to help launch creative careers.

Promoter: Deutsche Bank AG, [London branch, Winchester House, 1 Great Winchester Street, London, EC2N 2DB] (“Promoter”).

  1. 1. ELIGIBILITY FOR ENTRY
    1. 1.1The Competition is only open to individuals who are eligible, as detailed on the eligibility page.
    2. 1.2In the event that a group of individuals make an entry, one individual within the group must comply with criteria 1.1 above.
    3. 1.3For the avoidance of doubt, a participating academic institution is an institution which has registered on the DBACE website using the required sign-up form.
    4. 1.4All entries must be made personally by each individual entrant or by a group of individuals as per 1.2. Entries on behalf of another person or group will not be accepted.
    5. 1.5An individual or group can only enter the Competition once.
    6. 1.6The Promoter may, at its sole discretion, refuse to accept submitted entries. For example, the Promoter will not accept any entries that are incomplete or unintelligible or which contain defamatory, malicious or inappropriate content.
    7. 1.7In entering the Competition, entrants confirm that they are eligible to do so and eligible to claim the prize. The Promoter may require entrants to provide proof that they are eligible to enter the Competition and for proof of identity. Failure to provide this proof may result in disqualification from the Competition.
    8. 1.8For the avoidance of doubt, entrants must satisfy the above eligibility criteria at the time of registration and throughout the period of the Competition.
  2. 2.HOW TO ENTER
      1. 2.1.1The Competition will run from 9am on 16 January 2017 (the “Opening Date”) to 12.00am midnight on 12 March 2017 (the “Closing Date”) inclusive.
      2. 2.1.2Participation in the Competition is free to enter and no purchase is necessary.
      3. 2.1.3All entries must be submitted by application form via www.dbace.uk.com (“DBACE website”) by the Closing Date.
    1. 2.2Each entrant must choose to enter one of five categories: Art and Photography; Craft and Design; Film; Performance and Music (referred to as “Category” or “Categories”).
    2. 2.3Entrants must submit a plan for a creative project in one Category using the application form and fulfilling specifications as prescribed on the DBACE website by the Closing Date. Due to size limits, entrants with more than 30mb (depending on your broadband speed) may not be received by the Promoter.
    3. 2.4Entrants will need to provide their name, course, year of study and university and confirm contact details so the Promoter can notify the entrant if they have been successful. It is the responsibility of each entrant to notify the Promoter of any change of contact details. The Promoter will not be held responsible if a communication has not been received by the shortlisted entrants.
    4. 2.5After the Closing Date, the Promoter will use a pre-selected panel of shortlisters (“the Shortlisters”) to determine which entrants will be shortlisted. Up to 5 entrants will be shortlisted for each Category.
    5. 2.6Shortlisted entrants will be contacted by the Promoter by 10 April 2017, provided with feedback from the shortlisting panel and be invited to prepare a pitch and attend the final pitching day 17 May 2017 in front of a panel of judges.
    6. 2.7Pitching Day (17 May 2017)
      1. 2.7.1The Promoter will provide financial assistance for travel within European Countries to enable the Shortlister(s) to attend the Pitching Day. For the avoidance of doubt, the Promoter does not act as a travel agent for the Shortlister(s). Unless otherwise agreed with the Shortlister(s) any travel will be booked by the Promoter on behalf of the Shortlister(s) at the Promoter’s expense.
      2. 2.7.2This financial assistance includes a return train/flight between your nearest train station/airport (if applicable). Please note that the tickets will be booked as agreed between the Promoter and the Shortlister(s) and any bookings made by the Promoter will be on behalf of the Shortlister(s) at the Promoter’s expense for a particular journey. It is the responsibility of those Shortlister(s) to ensure they arrive at the airport/station in time for their journey. The Promoter will not be able to transfer the booking if the Shortlister(s) miss their flight/train journey;
  3. 3WINNER ANNOUCEMENT
    1. 3.1One winner per Category shall be selected by the panel of judges and announced during a ceremony on the evening of 17 May 2017.
  4. 4PRIZES
    1. 4.1The prize is £10,000.00 to fund their creative project and a year of business mentoring. All Shortlisters will be invited to attend a two day intensive Small Business Training Course, regardless of whether they are an overall winner.
    2. 4.2Small Business Training Course (Dates to be confirmed during Summer 2017)
      1. 4.2.1The Small Business Training shall be held at one of Deutsche Bank’s offices in London and it is anticipated that it shall be run by the London Small Business Centre.
      2. 4.2.2The Promoter will provide financial assistance for travel within European Countries and, if necessary accommodation, to enable the Shortlister(s) to attend the Small Business Training. For the avoidance of doubt, the Promoter does not act as a travel agent for the Shortlister(s). Unless otherwise agreed with the Shortlister(s) any travel or accommodation will be booked by the Promoter on behalf of the Shortlister(s) at the Promoter’s expense.
      3. 4.2.3This financial assistance includes:
        1. Aif applicable, accommodation in London for an overnight stay for the night between the two Small Business Training days as agreed between the Promoter and the Shortlister(s) and booked by the Promoter on behalf of Shortlister(s) at the Promoter’s expense. Please note if Shortlister(s) reside in London or locations within easy reach of London, no accommodation will be provided but appropriate travel expenses will be reimbursed;
        2. B(B) a return train/flight between your nearest train station/airport (if applicable). Please note that the tickets will be booked as agreed between the Promoter and the Shortlister(s) and any bookings made by the Promoter will be on behalf of the Shortlister(s) at the Promoter’s expense for a particular journey. It is the responsibility of those Shortlister(s) to ensure they arrive at the airport/station in time for their journey. The Promoter will not be able to transfer the booking if the Shortlister(s) miss their flight/train journey;
    3. 4.3Entrants who are winners agree that:
      1. 4.3.1they will participate in reasonable publicity relating to the Competition and consents to the use of their name and image by the Promoter for publicity purposes; and
      2. 4.3.2they will respond to e-mails from the Promoter’s Corporate Social Responsibility team and DBACE delivery partner in a timely way;
      3. 4.3.3they will maintain reasonable communication with DB for the period of one year from 17 May 2017 until 17 May 2018, and in particular:
        1. Asubmit a report to DB at six months detailing their progress to date; and
        2. Bparticipate in mentoring with their allocated mentor in a form to be mutually agreed between mentor and winner; and
        3. Cassist DB by providing feedback on the DBACE competition and award process and Small Business Training.
    4. 4.4The prize does not include any work experience.
    5. 4.5There are no alternative prizes and the prizes is not negotiable or transferable.
  5. 5.LIMITATION OF LIABILITY
    1. 5.1Insofar as this exclusion is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate the winners or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize or participating in the Competition provided that this limitation of liability shall not apply in respect of death or personal injury caused by the negligence of the Promoter or of those for whom it is responsible. Entrants’ statutory rights are not affected.
  6. 6.OWNERSHIP OF COMPETITION ENTRIES AND INTELLECTUAL PROPERTY RIGHTS
    1. 6.1The Promoter does not claim any rights of ownership in any Competition entry.
    2. 6.2Each entrant agrees:
      1. 6.2.1that the Promoter may make the DBACE plan summary and image submitted available on its website or any other media whether now known or invented in the future, and solely for the purposes of publicising the Competition; and
      2. 6.2.2to grant the Promoter a non-exclusive, worldwide, irrevocable licence, for the full period of any intellectual property rights in the submitted DBACE plan summary and image, to use, display, publish, transmit, copy, edit, alter, store, re-format and sub-licence the Competition entry for such purposes set out in clause 6.2.1.
    3. 6.3Winning entrants agree:
      1. 6.3.1that the Promoter may make entries available on its website or any other media whether now known or invented in the future, and solely for the purposes of publicising the Competition; and
      2. 6.3.2to grant the Promoter a non-exclusive, worldwide, irrevocable licence, for the full period of any intellectual property rights in the Competition entry, to use, display, publish, transmit, copy, edit, alter, store, re-format and sub-licence the Competition entry for such purposes set out in clause 6.3.1.
    4. 6.4The Promoter is the owner or the licensee of all intellectual property rights its website and other media, and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.
  7. 7.PERSONAL DATA
    1. 7.1By entering the Competition, entrants agree that any personal information provided by them with the Competition entry may be held and used only by the Promoter or its agents and suppliers to administer the Competition.
    2. 7.2Entrants agree to the use of their name, image and DBACE plan summary by the Promoter for publicity purposes.
    3. 7.3Subject to clause 7.2, entrants’ personal information will not be passed on to third parties. All personal information is treated as confidential.   8. 8.GENERAL
    1. 8.1For the avoidance of doubt, the winners are not guaranteed employment with the Promoter or any of its affiliates.
    2. 8.2When accessing the Promoter’s premises, each winner agrees to comply with the Promoter’s policies, including but not limited to the Promoters’ confidentiality, health and safety and security policies.
    3. 8.3If there is any reason to believe that there has been a breach of these Terms, the Promoter may, at its sole discretion, reserve the right to exclude entrants from participating in the Competition.
    4. 8.4The Promoter reserves the right to hold void, suspend, cancel, or amend the Competition where it becomes necessary to do so for any reason.
    5. 8.5The Promoter may revise the Terms at any time by amending this page.
    6. 8.6These Terms shall be governed by English law, and the parties submit to the exclusive jurisdiction of the courts of England and Wales.
